Today we had a nice visit from Ms. Elisa Tricerri from Studio Torta. After catching up, she gave us a detailed explanation of the EUIPO guidelines issued in March of 2024 which clarify how cancellation actions based on trademark applications filed in bad faith should be evaluated. She also outlined how re-filing identical applications to extend deadlines and grace-periods for proof of use, etc. was now seen as “bad-faith” activity by the applicant and may no longer be permitted. We then discussed how the JPO and EUIPO systems differ on this point, and how those differences could affect customer strategy in IP right procurement and enforcement going forward.
