We are pleased to announce that the logo for “Kajyu Gummy” (“Juicy Gummy”), represented by our firm on behalf of Meiji Co., Ltd., was officially registered as a trademark on September 5, 2025.
During the examination and appeal proceedings at the Japan Patent Office, the trademark was initially deemed to lack distinctiveness under Article 3(1)(iii) of the Trademark Act, as it was considered merely descriptive of the product’s characteristics. However, after a comprehensive consideration of factors such as over 35 years of continuous sales, extremely high market share value and strong product brand recognition, the trademark was granted registration based on acquired distinctiveness through use, as stipulated in Article 3(2) of the Trademark Act.
In the course of this registration process, our client was extremely helpful in gathering a large amount of supporting evidence. Our firm’s strategy focused not only on presenting objective statistical data but also on conveying the client’s intentions and efforts behind the product naming through the submission of carefully prepared and detailed documentation.
